Privacy Policy

This Privacy Policy explains how Doughboy Recreational, a division of Hoffinger Industries ("Doughboy", "we", "us" or "our") collects, uses, shares and protects personal information through doughboypools.com (the "Site"), and the choices and rights you have. Doughboy Pools, Embassy Pools and Lomart are pool brands made by the same manufacturer in West Helena, Arkansas. Their websites share one set of systems, so if you use more than one of them, we keep one customer record for you across them.

We are a manufacturer. We do not sell products to the public through the Site: our products are sold, installed and serviced by independent authorized dealers, who handle the information you give them under their own privacy practices.

1. Information we collect

Information you give us

• Contact, Find A Dealer, safety sticker and promotion forms: your name, email address, mobile phone number, ZIP code (required, so we can send your request to the right dealer), your message, and, for a sticker request, your mailing address.
• The pool builder and quote requests: the pool you design (type, shape, size, model, liner and options), your email address if you save a design, and, when you ask for a quote, your contact details and ZIP code.
• Warranty registration: your name, email address, phone number, the address where the pool is installed, the purchase date, the products and dealer, who installed it, an image or PDF of your receipt where the form asks for one, and whether you would like to receive news and offers from us.
• Photo and image contest entries: the photographs you upload and the name and contact details you submit with them.
• Your account: your email address and the profile details you choose to add. You sign in with a link we email to you; we do not ask for a password.

Information collected automatically

• Always, to run and protect the Site: your IP address, browser and device information, and the pages you request, in our server logs and in the records we keep to limit form submissions and stop spam.
• Only if you allow analytics cookies: the pages you view and how you use them (time on page, scrolling, the choices you make in the pool builder and on product pages, the buttons you click on promotion pages), the page that referred you and any campaign parameters in the link (such as utm codes or ad click identifiers), your screen size, and an approximate location (city, region, postal code and coordinates derived from your IP address). This is recorded by our own first-party analytics and by Google Analytics. See our Cookie Policy.
• Only if you allow marketing cookies: information collected by the Meta Pixel, Klaviyo and Google Tag Manager about your visit, used to measure and improve our advertising and our emails.
• Your device's location, only if you ask: when you choose "Use My Location" to find a dealer, your browser shares your location with the Site for that search.

Information from others

Authorized dealers may tell us how they followed up on your request and whether it led to a purchase, and the dealer you name in a warranty registration may confirm the purchase.

2. How we use information

• To send your inquiry, quote request or design to an authorized dealer near the ZIP code you gave, so that the dealer can contact you, and to follow up on how the request was handled.
• To respond to you, and to send the emails you ask for or that our service needs: sign-in links, saved designs, quote and inquiry confirmations, and warranty registration confirmations.
• To register and administer warranties, and to verify purchases.
• To run promotions and contests you enter.
• To send you news, offers and pool-care tips if you opt in. You can unsubscribe at any time using the link in any marketing email.
• With your consent, to understand how the Site is used, improve it, and measure and improve our advertising.
• To keep the Site secure, prevent spam and fraud, and comply with the law.

3. How we share information

• Authorized dealers. When you submit a form or a quote request, we share your name, contact details, ZIP code, message and pool choices with the authorized dealer who serves your area. Dealers are independent businesses and use your information under their own privacy practices.
• Our affiliated brands. Doughboy Pools, Embassy Pools and Lomart share one set of systems and one customer record.
• Service providers who process information for us under contract: Google Cloud and Firebase (hosting, databases, file storage, analytics storage, and notifications to dealers), Klaviyo, Postmark and Mailgun (email), Google Maps Platform (dealer maps, address and ZIP code look-up), and, if you allow analytics or marketing cookies, Google (Google Analytics and Google Tag Manager), Meta Platforms (the Meta Pixel) and Klaviyo (onsite tracking).
• For legal reasons: to comply with law or legal process, to enforce our terms, and to protect the rights, property and safety of our customers, dealers, the public and us.
• In a business transfer, such as a merger, acquisition or sale of assets, subject to this Policy.

We do not sell your personal information for money. If you allow marketing cookies, the Meta Pixel and similar tools may receive information about your visit that they use for advertising, which some state laws treat as a "sale" or "sharing" of personal information. You can refuse or withdraw that at any time in Cookie Settings, and we treat a Global Privacy Control signal from your browser as a request to opt out.

4. Cookies and similar technologies

Strictly necessary cookies keep the Site working. Analytics and marketing cookies are used only if you allow them, and Global Privacy Control is honored as an opt-out. Our Cookie Policy lists every cookie, and you can change your choice at any time in Cookie Settings.

5. How long we keep information

We keep personal information only as long as we need it for the purposes above, including our legal, warranty, tax and record-keeping obligations. In particular:

• Account sign-in sessions expire after 30 days, and emailed sign-in links expire shortly after they are sent.
• Warranty registrations are kept for the life of the warranty and as long afterwards as we need them for claims and records.
• Inquiries and quote requests are kept so that we and the dealer can follow up and keep business records.
• When you delete your account, your profile and saved pool designs are deleted. Quotes that were already sent to a dealer and warranty records are kept, with your personal details removed, because they are records of a transaction or a warranty.
• When we erase your personal information, the analytics records about your visits are redacted: your name, email address, phone number, IP address, device and location details are removed or replaced, while the anonymous counts (for example, that a page was viewed) are kept. Photographs you enter in a photo contest are governed by the Photo Contest Rules and Release you accept when you enter, under which you release the photographs, and your likeness in them, to us. They are therefore not covered by a request to delete your personal information. Your other personal information is: when we erase it, your name, email address, phone number and other contact details are removed from your entry.

6. Your choices

• Cookies: accept, reject or choose by category in Cookie Settings, at any time.
• Global Privacy Control: if your browser sends it, we treat it as an opt-out of analytics and marketing cookies.
• Marketing email: unsubscribe using the link in any marketing email, or contact us.
• Your account: view and update your profile, or delete your account, from your account.

7. Your privacy rights

Depending on where you live, you may have the right to:

• know and access the personal information we hold about you, and receive a copy in a portable format;
• correct inaccurate personal information;
• delete personal information;
• opt out of the sale or sharing of personal information, of targeted (cross-context behavioral) advertising, and of profiling that produces legal or similarly significant effects (we do not carry out such profiling);
• limit the use of sensitive personal information (we do not collect it for the purpose of inferring characteristics about you); and
• appeal our decision on your request.

We will not discriminate against you for exercising these rights.

California residents

The California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), gives California residents the rights above. In the past 12 months we have collected these categories of personal information: identifiers (name, email address, phone number, postal address, IP address, online identifiers); customer records (warranty and purchase details); commercial information (products you are interested in, designs, quote requests, purchases reported by dealers); internet or other electronic network activity (how you use the Site, if you allow analytics or marketing cookies); geolocation data (approximate location from your IP address, and your device's location if you choose "Use My Location"); and audio, electronic or visual information (receipts and photographs you upload). We collect it from you, from your browser or device, and from authorized dealers, for the purposes in section 2, and we disclose it to the categories of recipients in section 3. We do not sell personal information for money; the only "sale" or "sharing" as the CCPA defines it is through marketing cookies, if you allow them, and you can opt out as described above. We do not knowingly sell or share the personal information of consumers under 16.

Residents of other states

Residents of other states with consumer privacy laws, such as Colorado, Connecticut, Virginia, Utah, Texas, Oregon and others, may have similar rights. If we deny your request, you may appeal by replying to our decision or contacting us with "Privacy appeal" in the subject line; we will respond within the time the law of your state requires, and if we deny your appeal you may contact your state Attorney General.

How to make a request

Contact us by email at info@doughboypools.com, by phone at 877-228-4586, through our contact form, or by mail at 315 North Sebastian Street, West Helena, Arkansas 72390, and tell us which right you wish to exercise. To protect your information, we will verify your request by confirming details you have given us, such as your email address. You may use an authorized agent, who must provide proof of your authorization. We respond within 45 days, or within the period your state's law requires, and will tell you if we need more time.

8. Children

The Site is intended for adults and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, contact us and we will delete it.

9. Security

We use administrative, technical and physical safeguards appropriate to the information we hold, including encrypted connections to the Site and restricted access to our systems. No method of transmission or storage is completely secure.

10. Where information is processed

The Site is intended for visitors in the United States. Information is processed and stored in the United States.

11. Other websites

The Site links to and embeds content from other websites and services, such as video players, maps and social media. Their own privacy policies apply to what they collect.

12. Changes to this Policy

We may update this Policy. We will post the new version on this page with a new "Last updated" date and, if the changes are significant, give additional notice on the Site.
